Well this marks a new low for the justice system, what does this guy think, that by acting like an ass then suing he gets a free pass, I don't think so, besides what evidence does he have that Microsoft and Nintendo don't ban people from their services, this is a frivolous lawsuit through and through and I hope he ends up losing and having to pay all legal costs, for himself and Sony. Besides, pain and suffering because you couldn't play Resistance, why not play something else, or better yet, next time don't act like an asshole and you wouldn't get yourself banned in the first place, it's not like he wasn't given chances, it takes more than one report to get banned for good.

I think I'm gonna side with Sony here. I mean, I know the guy has an anxiety disorder and all, but he must have been doing some seriously bad stuff to warrant a ban.

Plus (though I can't say I've read it), wouldn't Sony's T&C state that players who constantly bad-mouth others will face a ban, regardless of their first amendment rights?

That's the whole thing, PSN is provided for free and you have to accept the Terms and Conditions to use it so what did he lose, the privilege to play online, it's not a right, you didn't lose out on a service you payed for and that's what the Terms and Conditions are for, so you can't do what this player is trying to do, should be an open and shut case, I mean what judge is going to allow this to continue.

It is stated in the terms that you must abide by the rules or be removed. It even says it AGAIN everytime you boot up resistance online. With resistance its in bold letters at the top none the less, even mentions "obscure" gestures like tbagging lol.

As for this i dont believe he suffers from anything. I for one rather be at home and i hate talking to people in public, but i dont "suffer" from it. I think everyone is like that, even public icons. Who wouldnt rather be in the safe compfort of their home?

It's like so many others, they claim they have mental disorders so they can get past the law or in this case take advantage of companies because I seriously doubt this person is clinically an agoraphobiac and if he is, it's still not the grounds for a claim of pain and suffering, I mean it's not like his PlayStation 3 ceases to function completely, he can still play the game offline, the online section of all almost all games usually has a disclaimer saying they are under no obligation to continue online services forever, so what 10 years down the road he would have sued because they disconnected the online.

On a separate note, I believe they actually ban your specific console from the network, since each console has a unique number and it's most likely checked before you go online otherwise if it just was an IP ban, that could be circumvented easily and this person probably wouldn't be suing.

They only ban your full system if you absolutely terrible person. Like sharing games with 50 people or "hacking" and "spamming" accounts or just a complete douchbag online. It would take so many reports just to get banned in the first place.

In this case its probably just a account ban, not a perm ban. he can easily open a new account and play, that and its probably just a temp ban on his account. They will reactivate it in like a month or so, if i was Sony i just completely ban this kid from online all together now though.

In all honestly I hope they do permanently ban him from the network if it hasn't already been done and slap him with all the legal fees when he loses and I don't think he can afford much since he is representing himself in the case or maybe he will call in Jack Thompson, after all it's right up his alley. Then we will all have the last laugh and can say, you deserved it.

he should be banned permanently just for punishment for behaving badly then trying to make it look like it's Sony's fault

There's no saying this will even go much further, most likely it will either be thrown out of court, because let's face it, the evidence he is using is absolutely ridiculous, Microsoft and Nintendo don't ban people, yeah that's an excuse as to why Sony can't plus how can he prove it and then Sony can just pull out the EULA they have on both the PlayStation Network account sign-up and before you can even play Resistance online and could easily prove to a judge he accepted. He will lose and if for some reason he ever got anything (Like if the judge was a total imbecile), I have a feeling a lot of gamers would be looking him up for some revenge, not that I condone that, but I'm sure somebody would.
